The below-mentioned terms & conditions are applicable to Participant and his/ her Co Passengers of the Event.
1. Eligibility: The Event is open to Indian Nationals of above 18 years of age, residing in India, who owns any of the variants of Hyundai SUV - Creta, Venue, Tucson & Alcazar (“Car”) only.
2.Registration: During the Term, the interested Participants shall,
a. Submit their Entries (Entry) on or before the prescribed last date mentioned for respective Events by logging-into the Microsite www.hyundaiexplorers.com/ in (hereinafter called as the “Site”) interfaced/linked with the Website www.hyundai.com/in (Website) and fill the information (valid phone/mobile number, email ID etc.) for participating in the Event. Hyundai shall at its discretion, extend or reduce the timeline for submission of Entries.
b. Make Entry Fee of INR 14,999/- (Fourteen thousand nine hundred and ninety-nine only) per couple or two adults and INR 7,499/- (Seven thousand nine hundred and ninety-nine only) for 3rd co-passenger.
c. Submit the required documents
The submission of false, incorrect, misleading, or fraudulent documentation may result in disqualification from the Event.
3. Cancellation & Refund of Entry Fee:
In the event the Participant cancels the participation,
a) 25% of the entry fee will be deducted if the cancellation is 30 days prior to Event date.
b) 50% of the entry fee will be deducted if the cancellation is 29 to 15 days prior to event date.
c) No refund if the cancellation is within 14 days prior to the event date.
d) All refunds will take up to 14 working days to process.
e) The refund will be remitted to the same account/Card from which Entry Fee have been received by Hyundai.
f) The Entry Fee paid will be refunded in case the registration is rejected by Hyundai or in case the Event is cancelled by Hyundai. The Entry Fee will not be refunded for any other reason (including Force Majeure Events) except those agreed above.
4. Selection: All the valid Entries submitted by the Participants will be evaluated by Hyundai. The decision of Hyundai in selecting the Participants will be final and binding on all the participants and no correspondence in this regard, shall be entertained under any circumstances of whatsoever nature. If Hyundai receives lot of Entries, Hyundai shall have the right to restrict number of Entries/Participants, considering the Hotel room availability, Covid-19 restrictions etc.
Any employee or associate of Hyundai, including but not restricted to vendors – Print, Audio & Visual media, Production Houses, Hyundai Dealers – is not eligible to attend the Event. Hyundai reserves the right at its sole discretion to cancel/withdraw participation of any Participant who is found to be an associate of Hyundai and its decision in this regard would be final and binding.
Hyundai reserves the right at its sole discretion to disqualify any Participant that it determines to be tampering with the process or the operation of the Event, to be acting in breach or potential breach of these Terms and Conditions.
Eligible Participants are not compelled in any way by Hyundai to participate and any such participation is voluntary
5. Participation: The Participant must come in his/ her own registered Car along with all original documents for each Co-passenger and the Car shall reach the starting point of the Event on the prescribed date and time for pre-event verification.
If a Participant is unable to reach the place of Event at scheduled date & time of the drive due to any reason whatsoever including loss of baggage or loss of travel documents, his/her booking shall be treated as "no show" on the Event and 100% cancellation charges will be levied.
6. Car & documents:
Car condition: The Participants shall ensure that the Cars brought for the Event are fit, serviced and technically ready for the Drives. Participants shall also ensure that their vehicles are driven by individuals lawfully licensed to drive the Car.
Documents: The Participants must have/carry Car insurance covering 1st party, 2nd Party as well as 3rd party individuals and properties, original valid Driving Licence and Registration Certificate, pollution certificate and such other documents of the Car during the Event.
7. Participant and Co-Passenger:
(hereinafter the Participant and his/ her Co-Passengers shall collectively be called as “Attendee”)
a) Participants are allowed to bring their kids or any other individual as the third participant for the Event. However, the drive allows maximum of 3 people per car, bringing more people will be subject to prior permission and agreement to bear the extra charges. All Attendees will be required to sign an indemnity bond before the start of the Event. In case of a minor, the indemnity bond should be executed through the minor’s guardian.Participants cannot transfer the opportunity of drive to any third party or modify/ postpone to a later date.
b) All Attendees shall have no Criminal proceeding pending against them as well as the Car shall not have involved in any Criminal incident. Such Attendees are not eligible to register/ attend the Event.
c) The Attendees shall follow all the instructions of the designated group leader appointed during the Event. Any actions of the Attendee in deviation to the group leader’s instructions may expose him/her and others to potential dangers and the disobedient Attendee shall be held responsible for any loss, injury, damage caused to other Attendees.
d) Attendees shall follow a strict no alcohol consumption policy while on the drive and consumption & carrying alcohol is strictly prohibited during the drive. In the event of any Attendee being found violating this rule, the convoy leaders will have the authority to take any necessary action which they deem fit, in the interest of safety of the group.
e) The Attendees shall follow the package itinerary. There shall be no refund, if the Attendee fails to join the group at the appointed time of commencement of the Event or join the group later or leave the group before the culmination of the drive. Please note that for all purposes, it shall be the responsibility of the Attendees to reach the place of commencement of the drive and register with the representative of Hyundai at the appointed place on the given date and time.
f) Hyundai shall not be responsible for any delay or alterations in the itinerary or expenses incurred - directly or indirectly by Attendees due to natural hazards, accidents, mechanical breakdowns, weather, sickness, landslides, political closures, prohibition orders, local unrest, traffic jams, medical emergency, or any untoward incident. Hyundai is not responsible for any mishap or unforeseen circumstances that may occur at any point of time.
g) Hyundai reserves the right to claim any additional expenses because of delays or alterations in the itinerary, caused by any reason whatsoever.
h) Hyundai reserves the right to, without prior notice, may extend the period for submission of Entries, amend, alter, vary, or withdraw any departure, excursion advertised/notified, reverse the order of places to be visited or substitute a hotel of similar class if deemed advisable or necessary.
i) Attendee’s itinerary and accommodation are subject to change, based on availability. Hyundai reserves the right to replace the itinerary and accommodation with similar alternatives.
j) The safekeeping or the Attendees’ Cars will remain the sole responsibility of the Attendees. Any damage caused to the Cars, during the journey because of accidents, negligence, natural causes shall be solely borne by the Attendees and Hyundai accepts no claim and responsibility for any damages and/or expenses suffered by the Attendee/Car.
k) In case an Attendee is compelled to discontinue the drive due to any reason whatsoever including illness, death or loss of any travel documents, no claim shall be entertained for refund of unutilized services. Further, Attendee shall pay for any towing / transportation costs involved in moving the Car.
l) Hyundai reserves the right to withdraw tour membership of any Attendee whose behaviour is deemed likely to affect the smooth operation of the outbound tour or adversely affect the enjoyment or safety of other passengers and Hyundai shall be under no liability to any such expelled person/s.
m) Aspects of the Event, like accommodation & food are being managed solely by the Service Providers nominated by Hyundai. All the terms & conditions of Service Providers, the third party (Hotels, Services and Service provider) are applicable and to be abided by the Attendees. Hyundai shall not be responsible for acts of any third party or Service Providers.
n) Medical condition: It shall be the duty of the Attendees to inform Hyundai and/or its Service Providers in case the Attendee has any medical history or prescribed restrictions/allergies that may affect his/her ability to enjoy and pursue fully the drive and wherein the interest of the group or any member thereof is prejudicially affected.
If a medical condition has been disclosed by the Attendee, Hyundai shall make an effort to provide basic medical help to such Attendee but under no circumstances shall Hyundai be held liable to any injury, disability, death, sickness etc., that the Attendee may suffer or be bound to provide any emergency assistance or refund the money.
o) Attendees shall use the Cars, in adherence to the itinerary and route instructions of the drive coordinator. It is responsibility of the Attendee to check the condition of the Cars, at the beginning of the drive. In the event of any breakdown of a Car during the drive, it is the responsibility of the Attendee to arrange for an equivalent alternative Car (SUV). Further, besides repair costs for damages caused to the Car, Attendee shall pay for any towing / transportation costs involved in moving the Car.
p) Any damage caused to the Car, during the drive because of accidents, negligence, natural causes shall be solely borne by the Attendee and Hyundai and/or its Service Providers shall accept no claim and responsibility for any damages and/or expenses suffered by the Attendee/Car.
q) Attendees will have to strictly adhere to the prescribed timetable for the day so the drive can be completed within the defined schedule. In case any of the sightseeing schedules are missed due to delays caused by the Attendee or for any other reasons, the same shall not be refunded to the Attendee under any circumstances.
r) Fuel and toll charges would have to be borne by the Participants for their Cars.
s) Carrying any banned/ prohibited materials in the Cars and/or any violation of Laws including Driving laws, Traffic laws and other Regulations committed by the Attendees, those violating Attendees alone shall be responsible for such violation and Hyundai will in no way responsible for the same. Any damage caused by any Attendee to any individual or property shall be adequately compensated by the respective Attendee, and Hyundai will in no way responsible for the same.
t) The Attendees shall maintain at most discipline without committing any nuisance to other individuals while driving as well as off Car activities (During stay at Hotels, Pit stops etc.). Hyundai reserves the right to withdraw tour membership of such Attendees who repeats such nuisance even after warning.
u) The Attendees shall maintain strict ‘COVID Protocols’ as long as it is in force and shall use sanitisers at regular intervals and mask while driving and maintain social distancing during off vehicle times activities.
v) Any damage caused to any Attendee while driving or during stay at hotel(s) and throughout the Event, the Attendee shall be liable to make good any damage(s) caused by any act of the Participant and the Co-passengers (wilful/negligent).
w) Event Package:
The details of inclusions & exclusions of Event are as follows:
Inclusions:
• Accommodation: 2 Nights stay included (double occupancy)
• Meals viz., Breakfast, Lunch & Dinner (both vegetarian and non-vegetarian) as per the restaurant offerings), Refreshments at pitstop/bio break & In-car refreshments
• Entry charges for venues/experiences & adventure activity and Entertainment experiences and Travel Insurance
• Local guidance from Drive experts, Go pro & Wireless radio set in individual cars
• Safety vehicle with First Aid medical assistance & Event related collaterals
• Giveaways & Kits
Exclusions:
• Flight tickets to and from respective locations & airport transfers
• Fuel & tolls charges & Vehicle servicing, repairs, toll taxes, and traffic fines
• Insurance and documentation cost such as car insurance, pollution, fastag, etc.
• Off-road shoes/gumboots
• Any additional service such as Refreshments/Lunch for visitors etc., provided by the hotel and any refreshment from the Mini fridge, room dine-in or alcoholic beverages
• Additional accommodation charges due to unforeseen delays in the journey, etc.
• Any charges for carrying video camera or still camera
• Any hotel, subsistence or other cost incurred prior to official start date of the expedition and after official end date of the expedition.
• Any kind of personal expenses or optional tours, extra meals, in-room dining, and beverages ordered, laundry, phone calls and medical expenses.
x) Hotel: Hyundai will make best efforts to procure the best hotels available in the price range keeping comfort and convenience of the Attendees as per the itinerary as priority and will be selected based on strong internal assessment.
While Hyundai will make efforts to ensure the delivery of services that are to be provided by the hotels, Hyundai act as a facilitator for the Attendee and the hotels and shall under no circumstance accept any request for change in Hotel or responsibility for inadequate/deficient/negligent services provided by the hotels. Hyundai shall not accept any complaints from the Attendee with respect to services provided by the hotels and that any grievance or complaint shall be directly lodged with the concerned hotel management.
The Attendee shall be liable to make good any damage(s) caused by any act of the Attendee (wilful/negligent) to the property of the hotels in any manner provided by the hotel policy. The extent and the amount of the damage so caused will be as determined by the concerned hotel. Hyundai shall not intervene in the same in any way.
y) Meals & Special Requests
The menu for all meals viz., Break-fast, Lunch & Dinner (both Veg & non-Veg) will be pre-set as per the packages.
Hyundai reserves the right to change the menu if circumstances necessitate such a change without any prior notice to the Attendee. If the Attendee does not avail the meals (as offered in the menu) for any reason, then no claim can be made for the unutilized meal against Hyundai and/or its Service Providers.
8. Force Majeure Neither party shall be held liable for damages or deficiency in service or loss, injury, expense, etc., in the event of the Event being delayed or cancelled or aborted after commencing due to any force majeure events including but not limited to Acts of God, natural calamities, prohibition orders, Government restrictions, lockdown, epidemic, pandemic, local unrest, traffic jams, medical emergency, accidents, etc. The Organisers shall be under no obligation to resume the Event on the situation having normalized after the Force Majeure event.
9. Liability
Hyundai shall not be responsible and / or liable for any damages caused to the Attendee due to Force Majeure Events.
Hyundai shall not be responsible for the temporary or permanent loss of or damage to baggage or personal effects howsoever caused including wilful negligence on the part of any person.
Hyundai shall not be responsible for any death, personal injury, sickness, accident, loss, delay, discomfort, increased expenses, consequential loss and/or damage or any kind of theft howsoever caused.
10. Indemnity
The Attendees unconditionally and irrevocably agree to hold Hyundai, its officers, directors, representatives and the Service Providers harmless and indemnified against any loss, damage, claim, suit, compensation, attorney expenses, criminal prosecution, Order of Court arising out of any injury, damage, loss of life of Attendees, life and property of any third party including but not limited to the Participants, co-passenger, the legal heirs or successors, individuals, government bodies, corporate entities, etc., resulting from the participation in the Event or due to direct or indirect acts of negligence, default, omission and commission on the part of the Attendee before the conclusion of the Drive.
11. IP Rights & Sharing of Personal Data
By participating in the Event, the Attendee hereby unconditionally and irrevocably agree to allow Hyundai to use his/her name and / or photograph and/or video and/or Audio for advertising or promotions related activities without demanding any compensation under any circumstances whatsoever from Hyundai.
The Attendee also authorizes Hyundai to willingly use any images/videos clicked by him/her, and which have been shared with Hyundai team or the authorized team during the drive, for use on their social media platforms.
12. Law & Jurisdiction
For any claims, suits, complaints, or disputes for service confining to the Event organised by Hyundai, the competent courts in Delhi, India alone shall have exclusive jurisdiction.
13.Participant Declaration
By clicking, I have understood and unconditionally accept the above-mentioned Terms and Conditions, the Terms of Use & Privacy Policy of the Website, by participating in the “HYUNDAI EXPLORERS”
